This shop (shop.emmasnutrition.com) is run by Hera Nutrition Ltd, trading as Emma's Nutrition, a company registered in England and Wales (company number 12124031). VAT number GB 379 0876 44.

2. These terms

These terms apply when you buy from our shop, along with our Shipping policy, Refund policy and Privacy policy. Please read them before you order. If you are buying as a consumer, nothing in these terms affects your statutory rights.

3. Placing an order

When you place an order, we'll email to confirm we've received it. This does not mean we have accepted it. Our contract with you starts when we email to tell you your order has been dispatched (or, for eBooks, when we send your download link).

We may decline or cancel an order before it's dispatched, for example if a product is out of stock, if it can't be sent to your delivery address, or if there's an obvious error in the price or description. If we do, we'll tell you and refund you in full.

4. Prices and payment

Prices are in pounds sterling and include VAT. Delivery charges are shown before you pay and are set out in our Shipping policy. Payment is taken when you place your order. If we've made an obvious mistake in a price, we'll contact you before dispatch and you can choose to go ahead at the correct price or cancel for a full refund.

5. Delivery

We deliver to the United Kingdom, the Isle of Man, Jersey and Guernsey. Delivery charges, dispatch times and any products we can't send to certain areas are explained in our Shipping policy. Responsibility for the goods passes to you when they are delivered to you or to someone you have nominated.

6. Cancellations and returns

You can cancel most orders within 14 days of receiving your goods, without giving a reason. Our Refund policy explains how to cancel and return goods, which products can't be returned once opened, and how refunds are made. If anything arrives damaged or faulty, or we send the wrong item, please email us and we'll put it right at no cost to you.

7. Digital downloads

eBooks are for your own personal use and must not be copied, shared or resold. We email your download link straight away after you've paid. If an eBook won't download or open, or is faulty, please email support@emmasnutrition.com and we'll help, replace it or refund you.

8. Food supplements and health information

Our food supplements are not intended to diagnose, treat, cure or prevent any disease, and should not be used as a substitute for a varied, balanced diet and a healthy lifestyle. Always follow the directions and warnings on the pack and do not exceed the recommended daily intake. If you are pregnant or breastfeeding, taking medication, under medical supervision or buying for a child, please speak to your doctor or other qualified healthcare professional before use.

Information on our website, including recipes and articles, is general information only and is not medical advice.

9. Our responsibility to you

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for business losses, as our products are for domestic and private use.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law, including your rights under the Consumer Rights Act 2015.

10. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as postal disruption or severe weather. If this happens, we'll let you know as soon as we can and take steps to minimise the delay. If the delay is likely to be substantial, you can cancel and receive a refund for anything you've paid for but not received.

11. Using our website

The content of this website, including text, images and recipes, belongs to Hera Nutrition Ltd or our licensors. You may view and print it for your own personal use, but you may not copy or use it for any other purpose without our written permission. Please don't misuse the website, for example by introducing viruses or trying to gain unauthorised access.

12. Your personal information

We use your personal information as set out in our Privacy policy.

13. Changes to these terms

We may update these terms from time to time. The terms that apply to your order are the ones shown on our website when you placed it.

15. Governing law

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
